Federal Appeals Court Reinstates FedEx Age Discrimination Case

You Have Rights As A Worker. I Will Help Protect Them.

An age discrimination case against FedEx Corporate Services Inc., which was dismissed by District Court, has now been reinstated by a federal appeals court. After 15 years’ employment, Teresita L. Viana was terminated by FedEx in 2016, supposedly for falsifying mileage expenses reports, however, the former home-based worker claims she was discriminated against on the grounds of her gender, Columbian national origin or ancestry, and age. 55-year-old Viana originally filed her lawsuit at the U.S District Court in Los Angeles. Following its reinstatement, the case has been remanded for further proceedings.

The claims made by Viana include sufficient evidence being provided to substantiate her mileage expense claims, derogatory and sexual remarks being made by FedEx employees towards her, and other instances of sexist and discriminatory behavior. Sadly, age discrimination cases like this one are a common occurrence in the caseloads of a Los Angeles discrimination attorney.

Common Discrimination Cases in Los Angeles

Discrimination of any kind is always unacceptable, but, unfortunately, there are far too many people who do not share this view. Discrimination remains far too common, and our Los Angeles attorneys regularly encounter lawsuits relating to:

  • Racial discrimination – employees should not be treated differently based on their race and, if your employer treats you unfairly, for this reason, you could be entitled to bring a discrimination suit.
  • Disability discrimination – California’s Fair Employment and Housing Act (FEHA) and The Americans with Disabilities Act (ADA) exist specifically to protect employees from disability-related discrimination.
  • National origin discrimination – you deserve to go to work without being disadvantaged due to your national origin. Decisions relating to promotions, pay increases, and similar, must not use this as a criterion.
  • Pregnancy discrimination – women who are pregnant or on maternity leave are also protected by law against discrimination.
  • Age discrimination – applicable to workers aged 40 or over, the ADEA protects against age discrimination.
  • Sexual orientation – legal protection is afforded to all Californians who experience discrimination based on their sexual orientation.

At The Kaufman Law Firm, we believe that everyone should be able to work without fear of discrimination and associated unwelcome behavior.
