An age discrimination case against FedEx Corporate Services Inc., which was dismissed by District Court, has now been reinstated by a federal appeals court. After 15 years’ employment, Teresita L. Viana was terminated by FedEx in 2016, supposedly for falsifying mileage expenses reports, however, the former home-based worker claims she was discriminated against on the grounds of her gender, Columbian national origin or ancestry, and age. 55-year-old Viana originally filed her lawsuit at the U.S District Court in Los Angeles. Following its reinstatement, the case has been remanded for further proceedings.
The claims made by Viana include sufficient evidence being provided to substantiate her mileage expense claims, derogatory and sexual remarks being made by FedEx employees towards her, and other instances of sexist and discriminatory behavior. Sadly, age discrimination cases like this one are a common occurrence in the caseloads of a Los Angeles discrimination attorney.
