Retaliation Takes On Many Forms

Remember being called a tattle-tale when in kindergarten? Tattle-tale was a nickname given to someone who told the teacher or some authority if someone else was breaking the rules. Tattle-tales reported on bad behaviour. As adults, we probably use the word snitch more often. In the business world, a whistleblower is a more appropriate word. The difference between a whistleblower and tattle-tale or snitch is a whistleblower is commenting on behaviour that legitimately hurts people who work at the company, agency, or organization as well as the consumers who purchase the products or services. Whistleblowers are applauded for their courage to stand up for what is right and tell the truth. However, there is a price to pay for exposing the truth. Our retaliation attorneys in Los Angeles CA at the Kaufman Law Firm are here to help you through the fallout.

What Is Retaliation

People who speak up to expose injustices or wrongdoing are never well received by the people who benefited from the injustice or wrongdoing. So, instead of applauding someone for speaking up, those who benefited or those who got in trouble start to retaliate.

Retaliation is unlawful especially if you end up getting let go or fired because of the decision you made to speak out. Common retaliation tactics are obvious and not so obvious:

  • In a recent report, 64% of people who spoke up experienced feeling left out of important decisions or activities because of their actions.
  • Around 62% were given the cold shoulder or were isolated from other employees
  • Almost half almost lost their jobs and almost half were passed up for a promotion or raise
  • After speaking out, 46% stated that their pay was cut or their hours were reduced. Even worse, 32% stated that they were demoted.

Dealing with retaliatory behaviour at work is difficult. 44% of employees dealing with retaliation resigned or relocated. Choosing to speak truths shouldn’t be so hard on the person who is just shining a light on the error. Yet, it happens all the time and in various industries.

For example, a woman lawyer is claiming retaliation after alerting the Los Angeles District Attorney Office of sexual misconduct. This is not the first allegation of sexual misconduct. Since last year, several attorneys and staff have been sent on administrated leave. The whistleblower states that her clients are being prosecuted unfairly because she chose to speak up. An investigation is still pending.
